Please read carefully. These Terms govern your use of services provided by SmartMob Deals. By placing an order with us, signing up to a plan, or using our website, you agree to these Terms. If you do not agree, please do not use our services.

1. About us

SmartMob Deals is an Australian-based telecommunications reseller providing NBN broadband, mobile and home phone services to residential and small business customers. In these Terms, "we", "us" or "our" means SmartMob Deals, and "you" or "your" means the customer.

Your service agreement with us consists of these Terms, our Critical Information Summary (CIS) for your chosen plan, our Acceptable Use Policy, our Privacy Policy, and any specific plan information provided to you in writing or by phone. In the event of inconsistency, the CIS for your specific plan prevails.

4. Plans and pricing

Plan prices, inclusions and speeds are shown on our website and confirmed in your Critical Information Summary. All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.

Our residential plans are offered on a month-to-month basis with no fixed-term lock-in contract unless you have specifically signed up to a fixed-term offer. Promotional pricing applies for the period stated at sign-up, after which standard pricing applies.

We may change pricing or plan inclusions by giving you at least 30 days' written notice. If a change materially disadvantages you, you may cancel your service without exit fees.

5. Service availability and speeds

Availability of NBN services depends on the technology type at your address (FTTP, FTTN, FTTC, HFC, Fixed Wireless or Satellite). Mobile coverage depends on the network we provide service on and your location. We will check availability at your address before activating service.

Speeds shown are typical evening speeds measured between 7pm and 11pm, in line with ACCC guidance. Actual speeds may vary based on the NBN technology at your address, your equipment, in-home wiring, number of users, and network congestion.

6. Activation and connection

We will use reasonable efforts to activate your service on the date confirmed at sign-up. Activation times depend on NBN Co or the carrier and we are not liable for delays caused by them. For most services, activation occurs within 1–10 business days of order.

Number porting is provided free of charge for most services. You authorise us to act on your behalf to port your number across from your previous provider.

7. Equipment

Where a modem or other equipment is supplied as part of your plan, it remains the property of SmartMob Deals unless explicitly purchased outright. You must take reasonable care of the equipment and return it in working order if you cancel your service within the first six months of a plan that included a free modem, otherwise a replacement fee may apply (the amount is shown in your CIS).

8. Payments and billing

Your service is billed monthly in advance. You authorise us to charge your nominated payment method on the same date each month. If a payment fails, we may suspend your service after reasonable notice and a $15 dishonour fee may apply.

Invoices are sent by email. If you wish to dispute an invoice, you must contact us within 14 days of the invoice date.

10.1 Cancellation by you

You may cancel your month-to-month service at any time by calling us on 1800 864 961. Cancellation takes effect at the end of your current billing cycle. There are no exit fees for month-to-month residential plans.

10.2 Suspension or cancellation by us

We may suspend or cancel your service if you breach these Terms, fail to pay an invoice after reasonable notice, use the service unlawfully, or if required by law or by our wholesale carriers.

If you experience a fault or service issue, please call us on 1800 864 961 or email support@smartmobdeals.com.au. We aim to respond to all support requests within one business day and to resolve most faults within 1–5 business days, depending on the cause.

12. Liability and consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits your rights under the Australian Consumer Law or the Telecommunications Consumer Protections (TCP) Code.

To the extent permitted by law, our liability for any failure to comply with a non-excludable consumer guarantee is limited (at our option) to re-supplying the service, paying the cost of having the service re-supplied, or refunding the cost of the service for the relevant period.

We are not liable for indirect or consequential loss, or for outages caused by NBN Co, mobile carriers, force majeure events, or factors outside our reasonable control.

If you have a complaint, please contact us first on 1800 864 961 or email complaints@smartmobdeals.com.au. We will acknowledge your complaint within 2 business days and aim to resolve it within 10 business days.

If you are not satisfied with our response, you can lodge a free complaint with the Telecommunications Industry Ombudsman (TIO):

We handle your personal information in accordance with our Privacy Policy and the Australian Privacy Principles.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will give you at least 30 days' notice by email. If the change materially disadvantages you, you may cancel your service without exit fees.

16. Governing law

These Terms are governed by the laws of the Australian Capital Territory. Any dispute will be subject to the non-exclusive jurisdiction of the courts of the ACT.
